Step-by-step guide
What to check, gather and sign for I-485 Supplement A, from choosing the route to after you file. Guides are in English for now.
Check the route
Research reviewed 2026-10-03. Printed edition reviewed: 09/18/26. Edition reviewed October 3, 2026. Check USCIS acceptance again before filing; the printed OMB expiration is a separate date.
Check ordinary adjustment rules first
Do not add the supplement solely because of an overstay or unauthorized employment. Determine which bar applies and whether a relevant ordinary exemption resolves it.
Ask a lawyer or accredited representative about this step.
Review the historical filing and its merits
A qualifying petition/labor certification must have been properly filed by April 30, 2001 and approvable when filed. Review whether grandfathering was already consumed through residence on that filing; a receipt alone is not proof of merits.
Ask a lawyer or accredited representative about this step.
Distinguish historic derivative from later family
Historic derivative grandfathering requires a qualifying filing permitting INA 203(d) derivatives; immediate-relative filings do not create derivative grandfathering. Later accompanying family depends on the principal's actual 245(i) route and relationship timing.
Ask a lawyer or accredited representative about this step.
Apply the historical presence band
For qualifying filings January 15, 1998 through April 30, 2001, establish the principal beneficiary's December 21, 2000 U.S. presence; pre-January 15 filings use the different branch. Current visa basis/availability and admissibility remain necessary.
Ask a lawyer or accredited representative about this step.
